You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at contact@contentworks.site if you suspect any unauthorised access to or use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
5. Permitted Use
You may use our services only for lawful purposes and in accordance with these terms. You agree not to:
- Use the services in any way that violates applicable laws or regulations
- Transmit any material that is unlawful, harmful, defamatory, obscene, or otherwise objectionable

6. Intellectual Property
6.1 Our Content
All content, materials, software, trademarks, logos, and other intellectual property on our platform are owned by or licensed to Contentworks. Nothing in these terms grants you any right to use our intellectual property without our prior written consent.
6.2 Your Content
You retain ownership of any content you submit to our platform. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely to the extent necessary to deliver our services to you. You represent and warrant that you have all rights necessary to grant this licence.
6.3 Feedback
If you provide feedback, suggestions, or ideas regarding our services, we may use such feedback without restriction or compensation to you. You waive any rights you may have in such feedback to the fullest extent permitted.
7. Payments and Billing
Certain services may be subject to fees. All applicable fees will be disclosed prior to purchase. You agree to pay all charges associated with your use of paid services in accordance with the pricing and payment terms presented at the time of purchase.
All payments are processed securely through third-party payment providers. We do not store your full payment card details. Fees are non-refundable unless otherwise stated or required by applicable law.
We reserve the right to change our pricing at any time. Where a change affects your existing subscription or arrangement, we will provide reasonable notice before the change takes effect.
8. Cancellation and Termination
You may cancel your use of our services at any time by contacting us at contact@contentworks.site. Upon cancellation, your access to paid features will continue until the end of the current billing period unless otherwise agreed.
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, if we believe you have violated these terms or engaged in conduct that is harmful to us, other users, or third parties. Termination does not limit any other remedies we may have.
9. Third-Party Services and Links
Our platform may contain links to third-party websites or integrate with third-party tools and services. These are provided for convenience only. We do not endorse, control, or accept responsibility for any third-party content, products, or services. Your use of third-party services is subject to their respective terms and privacy policies.
10. Disclaimer of Warranties
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee specific outcomes or results from the use of our consultation services. Any guidance or recommendations provided are informational in nature and do not constitute professional advice in a legally regulated sense.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Contentworks and its directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising under or in connection with these terms will not exceed the total amount paid by you to us in the three months preceding the event giving rise to the claim, or fifty Australian dollars (AUD $50.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Contentworks and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of our services, your violation of these terms, or your infringement of any third-party rights.
13. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in that policy. We encourage you to review it carefully.
14. Communications
By creating an account or using our services, you consent to receiving electronic communications from us, including service-related notices, updates, and responses to your enquiries. You may opt out of non-essential communications at any time by following the unsubscribe instructions included in those messages or by contacting us directly.
15. Governing Terms and Dispute Resolution
These terms are intended to be interpreted broadly and fairly. In the event of any dispute arising from or relating to these terms or your use of our services, we encourage you to contact us first at contact@contentworks.site so that we may seek to resolve the matter informally.
If a dispute cannot be resolved informally within thirty days of written notice, either party may pursue resolution through binding arbitration or other appropriate legal proceedings as permitted by applicable law. Nothing in this clause limits either party's right to seek urgent injunctive or equitable relief where appropriate.
16. Severability
If any provision of these terms is found to be invalid, unlawful, or unenforceable, that provision will be deemed severed from the remaining terms, which will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable, where possible.
17. Entire Agreement
These Terms of Use, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Contentworks regarding your use of our services and supersede all prior agreements, representations, or understandings relating to the same subject matter.
